Welcome to AURRVIA. These Terms and Conditions ("Terms") govern your access to and use of our website at https://www.aurrvia.com and any purchases made through it. By accessing our website or placing an order, you agree to be bound by these Terms.

AURRVIA is a brand operated by PNM Gems & Jewellery, a business registered in Italy, with its registered address at Via Claudio Monteverdi 28, 50144 Firenze (FI), Italy. The physical retail premises operate under the name Ballini Gioielli. AURRVIA is also associated with the Comprooro label. All references to "we", "us", or "our" in these Terms refer to PNM Gems & Jewellery.

1. Eligibility

By using our website and placing an order, you confirm that you are at least 18 years of age (or the age of legal majority in your jurisdiction) and have the legal capacity to enter into a binding agreement.

2. Products and Descriptions

We make every effort to ensure that product descriptions, images, and prices on our website are accurate. However, due to the handcrafted nature of our jewellery and the natural characteristics of gemstones, slight variations in colour, size, and appearance may occur between the product shown on the website and the item you receive. Such variations are inherent to fine jewellery and are not considered defects.

All gemstones used in our collections are ethically sourced from Sri Lanka (Ceylon), and all goldsmithing is performed in our Florence atelier. Product specifications, including metal purity (e.g., 18KT gold), gemstone type, and weight, are stated on each product page.

3. Pricing and Currency

All prices displayed on our website are inclusive of applicable Value Added Tax (VAT/IVA) where required by law. Prices are listed in the currency shown on the website (EUR or as otherwise indicated). We reserve the right to change prices at any time without prior notice, but any price changes will not affect orders that have already been confirmed.

For customers outside the European Union, additional customs duties, import taxes, or fees may apply upon delivery. These charges are the responsibility of the customer and are not included in our prices.

4. Orders and Contract Formation

Placing an order on our website constitutes an offer to purchase. A binding contract is formed only when we send you an order confirmation email. We reserve the right to refuse or cancel any order at our discretion, including in cases of pricing errors, suspected fraud, or product unavailability. If we cancel an order, you will receive a full refund.

5. Payment

We accept various payment methods as displayed at checkout, which may include credit and debit cards, PayPal, and other payment options provided through Shopify Payments. All payments are processed securely through PCI-DSS compliant third-party payment processors. We do not store your full payment card details on our systems.

6. Shipping and Delivery

Please refer to our separate Shipping Policy for full details on shipping methods, estimated delivery times, and shipping costs. We ship internationally from our workshop in Florence, Italy. Risk of loss and title for items pass to you upon delivery to the carrier.

7. Right of Withdrawal (EU Consumers)

If you are a consumer within the European Union or the European Economic Area, you have the right to withdraw from your purchase within 14 calendar days from the date you receive the product, without giving any reason, in accordance with the EU Consumer Rights Directive (2011/83/EU) and Italian Consumer Code (D.Lgs. 206/2005).

To exercise this right, you must notify us of your decision by sending a clear statement to our email address before the 14-day period expires. Please refer to our Return and Refund Policy for detailed instructions.

Please note that the right of withdrawal does not apply to products that have been personalised, custom-made, or engraved to your specifications, as per Article 59(c) of the EU Consumer Rights Directive.

8. Limitation of Liability

To the fullest extent permitted by applicable law, PNM Gems & Jewellery shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the website or purchase of products. Our total liability for any claim shall not exceed the amount you paid for the relevant product.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law (including mandatory EU consumer protection laws).

9. Intellectual Property

All content on this website, including but not limited to the AURRVIA name, logo, product designs, photographs, text, graphics, and software, is the property of PNM Gems & Jewellery or its licensors and is protected by Italian, European, and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

10. User Accounts

If you create an account on our website, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use. We reserve the right to suspend or terminate accounts that violate these Terms.

11. Acceptable Use

You agree not to use our website for any unlawful or prohibited purpose, including but not limited to: attempting to gain unauthorised access to our systems, transmitting harmful or malicious code, engaging in fraudulent activity, or infringing on the rights of others.

12. Force Majeure

We shall not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, government actions, supply chain disruptions, or failures of third-party services.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Italy. For consumers resident in the EU, mandatory consumer protection provisions of the consumer's country of residence shall also apply where they provide greater protection. Any disputes shall be subject to the exclusive jurisdiction of the courts of Florence, Italy, without prejudice to the consumer's right to bring proceedings in the courts of their place of residence.

EU consumers may also submit disputes to the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
